Hello one and all hope all is well as can be. I am writing to you all today for some help and advise please. My place of work have turned round and told us we all need to wear face masks. I have already told them I am except from wearing one, my manager has asked me to write a letter to HR explain why I am unable to wear a covering. Could someone help me with a template and facts which I could send off to my boss and HR. I really appreciate all your help God bless you all. Andrew.

Hey Andrew This might help you Dear (XXX) I am writing to byourself, as I have been informed by (XXX) that I must wear a mask in the workplace or face disciplinary action. As I have made very clear to (XXX), I am exempt under the Government Legislation Exemptions from wearing a face covering of any type. There are many exemptions from wearing a face mask, which include hidden disabilities including - but not limited to; (i) because of any physical or mental illness or impairment, or disability (within the meaning of section 6 of the Equality Act 2010(1)), or (ii) without severe distress; https://www.legislation.gov.uk/uksi/2020/791/regulation/4/made In accordance of Section 6 of the 2010 Equality act; I am protected against unlawful discrimination by my employer because of my disability/medical exemption. Under the act, you have a duty of care to make reasonable adjustments for any individuale who is at a substantial disadvantage due to their (hidden) disability. I am legally under no obligation to divulge my private medical issues or provide proof in anyway of my exemption, as per the Data Protection Act 2018. I enjoy my job and I would like to keep this as civil as possible, but as per my rights, I will be taking legal action if I face any disciplinary action because of my disability. As far as I'm aware nobody has the right to know your medical details without your permission including your employers. The gov.uk website allows anyone to download a template advising they are exempt from wearing a mask. I'd download that and include with a short note to your HR Department. I'd also ask your employer where it is written in law to wear a mask in the workplace. It isn't!!!! I'd simply send them the exemption card downloaded from gov.uk and advise wearing a mask will be detrimental to both your physical and mental health. They do not need to know anymore than that. Best,
Could you not wear a shield? That is what I do
Any form of face covering or shield cause be very high discomfort and distress due to something my pass, this is just one of the reasons I am exempt. I has chatted to HR and they are looking into it but I bet my boss will cause a lot of problems ⚠️. Just needed to know in a legal sense where I stand too. Many thanks
I totally understand it does the same to me I only wear shield to walk between students or to walk on corridors but that starts to make me feel like I can not breath... I have severe claustrophobia... just can not bear anything in front of my mouth... i thought shield is better than mask as it is see through but at times I must remove it as it makes me feel like I can not breath... i made my husband a face mask out of net material (the one can be used for little girls skirt) he said he can breath in it.
